Reflecting on Memorial Day and the Reality of Death
Memorial Day is a time to honor the sacrifices of those who have fought for our freedoms. It’s also a time to reflect on life, death, and the legacies we leave behind. While the topic of death can be uncomfortable, it is an inevitable reality—one that brings chaos to the lives of those left behind. This is why estate planning is so crucial: it provides structure and order in the midst of loss.
The Role of an Estate Planning Attorney
As an estate planning attorney, I help individuals prepare for the inevitable by creating legal structures that ease the burden on their loved ones. Today, I created eight trusts—each one a gift of organization and order to the beneficiaries left behind.
I’ve seen firsthand the emotional turmoil of probate proceedings. When a family member passes away, those left behind are often overwhelmed with grief and legal complexities. Many times, I’ve had clients break down in tears during the probate process because they’re experiencing not only emotional loss but also the sudden disruption of their daily lives.
Understanding Death: Objective vs. Subjective Knowledge
Philosopher Søren Kierkegaard, the founder of existentialism, explored the concept of death and how we perceive it. He made an important distinction:
Objective knowledge – We intellectually understand that death is inevitable.
Subjective knowledge – We only truly comprehend death through the experience of losing a loved one.
Many people do not fully grasp the emotional weight of death until it directly affects them. I have only experienced profound loss once, with my grandmother, but I recognize that my clients who have lost spouses, parents, or children have a deeper understanding of death than I do.
The Chaos of Loss and the Role of Estate Planning
The closer someone is to us, the greater the disruption when they pass away. The loss creates a vacuum, a sense of disorder that can make life feel chaotic. Estate planning serves as a tool to bring order to this chaos, ensuring that the legal and financial aspects of a person’s passing do not add to the emotional burden.
Through estate planning, we create a roadmap that helps families navigate the challenges of losing a loved one. Having a structured estate plan allows survivors to focus on healing rather than legal battles.
Why You Should Prioritize Estate Planning
On this Memorial Day, take a moment to consider your own legacy. When you pass away, your family will face emotional turmoil. You can ease their burden by ensuring that your estate is properly planned and organized.
How Estate Planning Helps Your Loved Ones:
Reduces stress and confusion during a difficult time.
Ensures your assets are distributed according to your wishes.
Prevents legal disputes that can arise in probate.
Provides financial security for your heirs.
Estate planning is not just about wills and trusts—it’s about creating a lasting gift of stability for those you love. It is a profound and meaningful act that ensures your family can move forward without unnecessary hardship.
