How Long Do You Have to File Probate After Death?
In Texas, you have four years to file for probate after your loved one (the testator) or the person who created the will dies. Probate is necessary for specific types of assets that have a title or deed. Probate is required to transfer the title or deed to the beneficiaries. Not all assets need to be probated. For example, insurance policies, pension plans, and retirement accounts do not need to go through probate -- they may be transferred automatically to beneficiaries.
If probate is not filed within the four-year period, then the estate will be treated as if your loved one passed on without creating a will. They will be considered to have died intestate and their assets will be distributed to family or loved ones based on Texas intestate laws.
